1. Общие положения // General Provisions

1.1. 🇷🇺 Настоящие Условия использования (далее — «Условия») регулируют порядок использования узла lastfree.space социальной сети Friendica (далее — «Инстанс»), предоставляемой администрацией Инстанса (далее — «Администрация»).
🇬🇧 These Terms of Use (hereinafter referred to as the "Terms") regulate the use of lastfree.space instance of the Friendica social network (hereinafter referred to as the "Instance") provided by the Instance administration (hereinafter referred to as the "Administration").

1.2. 🇷🇺 Инстанс представляет собой платформу для общения, обмена информацией и публикации контента, функционирующую в соответствии с законодательством Российской Федерации.
🇬🇧 The Instance is a platform for communication, information exchange, and content publication, operating in accordance with the legislation of the Russian Federation.

1.3. 🇷🇺 Регистрация и использование Инстанса означают безусловное согласие пользователя с настоящими Условиями, а также с Политикой конфиденциальности, размещенной на сайте Инстанса.
🇬🇧 Registration and use of the Instance means the user's unconditional agreement with these Terms, as well as with the Privacy Policy posted on the Instance website.

1.4. 🇷🇺 Администрация оставляет за собой право вносить изменения в Условия. Пользователи будут уведомлены о существенных изменениях через интерфейс Инстанса или иным способом. Продолжение использования Инстанса после внесения изменений означает согласие с обновленными Условиями.
🇬🇧 The Administration reserves the right to make changes to the Terms. Users will be notified of significant changes through the Instance interface or by other means. Continued use of the Instance after changes are made indicates agreement with the updated Terms.

2. Регистрация и доступ // Registration and Access

2.1. 🇷🇺 Для использования Инстанса пользователь должен зарегистрироваться, предоставив достоверные данные, включая адрес электронной почты.
🇬🇧 To use the Instance, the user must register by providing accurate information, including an email address.

2.2. 🇷🇺 Пользователь несет ответственность за сохранность своих учетных данных (логина и пароля) и не должен передавать их третьим лицам.
🇬🇧 The user is responsible for maintaining the security of their account credentials (login and password) and must not share them with third parties.

2.3. 🇷🇺 Минимальный возраст для регистрации на Инстансе — 14 лет, в соответствии с законодательством Российской Федерации. Пользователи младше 16 лет обязаны получить согласие родителей или законных представителей.
🇬🇧 The minimum age for registration on the Instance is 14 years, in accordance with the legislation of the Russian Federation. Users under 16 years of age must obtain consent from their parents or legal guardians.

2.4. 🇷🇺 Администрация вправе отказать в регистрации или заблокировать учетную запись пользователя в случае нарушения настоящих Условий или требований законодательства.
🇬🇧 The Administration has the right to refuse registration or block a user's account in case of violation of these Terms or legal requirements.

3. Правила поведения пользователей // User Conduct Rules

3.1. 🇷🇺Пользователям запрещается:
🇬🇧 Users are prohibited from:

• 🇷🇺 Публиковать контент, нарушающий законодательство Российской Федерации, включая, но не ограничиваясь, призывы к экстремизму, насилию, дискриминации, распространение порнографических материалов, а также информации, запрещенной к распространению в РФ.
  🇬🇧 Publishing content that violates the legislation of the Russian Federation, including, but not limited to, calls for extremism, violence, discrimination, distribution of pornographic materials, as well as information prohibited for distribution in the Russian Federation.
• 🇷🇺 Размещать контент, нарушающий права третьих лиц, включая авторские права, право на изображение или конфиденциальность.
  🇬🇧 Posting content that violates the rights of third parties, including copyright, image rights, or confidentiality.
• 🇷🇺 Использовать Инстанс для рассылки спама, проведения мошеннических схем или иных противоправных действий.
  🇬🇧 Using the Instance for spam distribution, fraudulent schemes, or other illegal activities.
• 🇷🇺 Публиковать материалы, содержащие вредоносное ПО, ссылки на фишинговые сайты или иные ресурсы, представляющие угрозу для безопасности других пользователей.
  🇬🇧 Publishing materials containing malware, links to phishing sites, or other resources that pose a threat to the security of other users.
• 🇷🇺 Осуществлять действия, направленные на нарушение стабильности работы Инстанса, включая попытки несанкционированного доступа к серверам или учетным записям других пользователей.
  🇬🇧 Taking actions aimed at disrupting the stability of the Instance, including attempts of unauthorized access to servers or accounts of other users.

3.2. 🇷🇺 Пользователи обязаны уважать других участников Инстанса, воздерживаясь от оскорблений, угроз или дискриминационных высказываний.
🇬🇧 Users must respect other participants of the Instance, refraining from insults, threats, or discriminatory statements.

3.3. 🇷🇺 Пользователи несут ответственность за весь контент, размещенный от их имени, включая посты, комментарии, изображения и иные материалы.
🇬🇧 Users are responsible for all content posted in their name, including posts, comments, images, and other materials.

4. Модерация и ответственность // Moderation and Responsibility

4.1. 🇷🇺 Администрация осуществляет модерацию контента на Инстансе для обеспечения соблюдения настоящих Условий и законодательства Российской Федерации.
🇬🇧 The Administration moderates content on the Instance to ensure compliance with these Terms and the legislation of the Russian Federation.

4.2. 🇷🇺 Администрация вправе удалять контент или ограничивать доступ к учетной записи пользователя без предварительного уведомления в случае нарушения Условий.
🇬🇧 The Administration has the right to remove content or restrict access to a user's account without prior notice in case of violation of the Terms.

4.3. 🇷🇺 Пользователь, размещающий контент, подтверждает, что обладает всеми необходимыми правами на его использование и публикацию.
🇬🇧 The user posting content confirms that they have all necessary rights for its use and publication.

4.4. 🇷🇺 Администрация не несет ответственности за контент, размещенный пользователями, но обязуется принимать меры для удаления противоправного контента в порядке, установленном законодательством Российской Федерации.
🇬🇧 The Administration is not responsible for content posted by users but undertakes to take measures to remove illegal content in accordance with the procedure established by the legislation of the Russian Federation.

4.5. 🇷🇺 В случае получения запроса от уполномоченных государственных органов Администрация обязана предоставить информацию о пользователях или их действиях в соответствии с Федеральным законом № 152-ФЗ «О персональных данных» и иными нормативными актами.
🇬🇧 In case of receiving a request from authorized state bodies, the Administration is obliged to provide information about users or their actions in accordance with Federal Law No. 152-FZ "On Personal Data" and other regulatory acts.

[h2]5. Персональные данные //Personal Data

5.1. 🇷🇺 При регистрации и использовании Инстанса Администрация собирает и обрабатывает персональные данные пользователей в соответствии с Политикой конфиденциальности и Федеральным законом № 152-ФЗ «О персональных данных».
🇬🇧 During registration and use of the Instance, the Administration collects and processes users' personal data in accordance with the Privacy Policy and Federal Law No. 152-FZ "On Personal Data".

5.2. 🇷🇺 Пользователь дает согласие на обработку своих персональных данных, необходимых для предоставления услуг Инстанса, включая имя, адрес электронной почты и иные данные, указанные при регистрации.
🇬🇧 The user consents to the processing of their personal data necessary for providing Instance services, including name, email address, and other data specified during registration.

5.3. 🇷🇺 Администрация принимает все необходимые меры для защиты персональных данных пользователей от несанкционированного доступа.
🇬🇧 The Administration takes all necessary measures to protect users' personal data from unauthorized access.

6. Интеллектуальная собственность // Intellectual Property

6.1. 🇷🇺 Все материалы, созданные Администрацией (дизайн, логотипы, программное обеспечение Инстанса), являются объектами интеллектуальной собственности и защищены законодательством Российской Федерации.
🇬🇧 All materials created by the Administration (design, logos, Instance software) are intellectual property objects and are protected by the legislation of the Russian Federation.

6.2. 🇷🇺 Пользователи сохраняют права на контент, который они публикуют, но предоставляют Администрации неисключительную лицензию на его использование в целях функционирования Инстанса (например, отображение постов в ленте).
🇬🇧 Users retain rights to the content they publish but grant the Administration a non-exclusive license to use it for the functioning of the Instance (for example, displaying posts in the feed).

6.3. 🇷🇺 Запрещается копировать, модифицировать или распространять элементы Инстанса, принадлежащие Администрации, без письменного согласия.
🇬🇧 It is prohibited to copy, modify, or distribute Instance elements belonging to the Administration without written consent.

7. Ограничение ответственности // Limitation of Liability

7.1. 🇷🇺 Инстанс предоставляется на условиях «как есть». Администрация не гарантирует бесперебойную работу платформы и не несет ответственности за временные сбои или недоступность.
🇬🇧 The Instance is provided on an "as is" basis. The Administration does not guarantee uninterrupted operation of the platform and is not responsible for temporary malfunctions or unavailability.

7.2. 🇷🇺 Администрация не несет ответственности за любой ущерб, причиненный пользователям в результате использования Инстанса, за исключением случаев, прямо предусмотренных законодательством Российской Федерации.
🇬🇧 The Administration is not responsible for any damage caused to users as a result of using the Instance, except for cases directly provided for by the legislation of the Russian Federation.

7.3. 🇷🇺 Администрация не отвечает за действия пользователей, нарушающие права третьих лиц или законодательство.
🇬🇧 The Administration is not responsible for actions of users that violate the rights of third parties or legislation.

8. Прекращение доступа // Termination of Access

8.1. 🇷🇺 Пользователь вправе в любой момент удалить свою учетную запись через настройки Инстанса.
🇬🇧 The user has the right to delete their account at any time through the Instance settings.

8.2. 🇷🇺 Администрация вправе прекратить доступ пользователя к Инстансу в случае систематического нарушения Условий или по требованию государственных органов.
🇬🇧 The Administration has the right to terminate user access to the Instance in case of systematic violation of the Terms or at the request of government authorities.

8.3. 🇷🇺 При удалении учетной записи пользовательский контент может быть сохранен в течение срока, необходимого для выполнения требований законодательства Российской Федерации.
🇬🇧 When deleting an account, user content may be retained for the period necessary to comply with the requirements of the legislation of the Russian Federation.

9. Заключительные положения // Final Provisions

9.1. 🇷🇺 Настоящие Условия регулируются законодательством Российской Федерации.
🇬🇧 These Terms are governed by the legislation of the Russian Federation.

9.2. 🇷🇺 Все споры, связанные с использованием Инстанса, разрешаются в судебном порядке в соответствии с законодательством Российской Федерации.
🇬🇧 All disputes related to the use of the Instance are resolved through legal proceedings in accordance with the legislation of the Russian Federation.

9.3. 🇷🇺 Если какое-либо положение Условий признано недействительным, остальные положения сохраняют свою силу.
🇬🇧 If any provision of the Terms is found invalid, the remaining provisions remain in force.

9.4. 🇷🇺 По всем вопросам, связанным с использованием Инстанса, пользователи могут обращаться к Администрации через контактные данные, указанные на сайте Инстанса.
🇬🇧 For all questions related to the use of the Instance, users can contact the Administration through the contact information specified on the Instance website.

Rules

1. 🇷🇺 Регистрация на сервере доступна для всех. Вы можете пользоваться всеми функциями сервера без ограничения, пока это не нарушает другие правила сервера, права других пользователей и других сетей и законы РФ. 🇬🇧 Registration on the server is available for everyone. You can use all functions of the server without limitation, as long as it does not violate other rules of the server, the rights of other users and other networks and the laws of the Russian Federation.
2. 🇷🇺 Сервер создан и администрируется мной на чистом энтузиазме. Я не беру денег за использование его ресурсов. 🇬🇧 The server is created and administered by me on pure enthusiasm. I do not take money for the use of its resources.
3. 🇷🇺 Я осуществляю поддержку пользователей на добровольных началах, поэтому не устанавливаю срок ответа на ваше обращение. Также, я не могу гарантировать, что смогу решить вашу проблему. Но постараюсь сделать это. 🇬🇧 I provide user support on a voluntary basis, so I do not set a response time for your request. Also, I cannot guarantee that I will be able to resolve your issue. But I will try my best to do so.
4. 🇷🇺 Аккаунты, в информации о которых указаны реквизиты (адреса, телефоны, e-mail) коммерческих организаций, а посты или отсутствуют или содержат, в основном, рекламную информацию, удаляются без предупреждения. 🇬🇧 Accounts whose information contains details (addresses, phone numbers, e-mail) of commercial organisations and whose posts are either absent or contain mainly advertising information will be deleted without warning.
5. 🇷🇺 Неактивные аккаунты удаляются без предупреждения. Под "неактивным" имеется в виду аккаунт, в который пользователь не заходил в течение года. 🇬🇧 Inactive accounts will be deleted without warning. Inactive’ means an account that has not been accessed for a year.
6. 🇷🇺 На инстансе запрещено размещение материалов, пропагандирующих превосходство одних людей над другими по свойствам, не зависящим от них: раса, национальность, место рождения, пол, сексуальная ориентация, внешность и т. д. 🇬🇧 It is forbidden to post materials promoting the superiority of some people over others on the basis of properties independent of them: race, nationality, place of birth, gender, sexual orientation, appearance, etc. on the Instance.
7. 🇷🇺 На инстансе запрещено размещение материалов, связанных с распространением наркотиков, оружия, взрывчатки, порнографии и других материалов, запрещенных законом. 🇬🇧 The instance prohibits the posting of materials related to the distribution of drugs, weapons, explosives, pornography, and other materials prohibited by the law.
8. 🇷🇺 На инстансе запрещено хамское, оскорбительное отношение к другим пользователям этого сервера и других узлов Fediverse. 🇬🇧 Boorish, abusive behaviour towards other users of this server and other Fediverse nodes is prohibited on the instance.
9. 🇷🇺 На инстансе запрещены назойливая реклама и спам. 🇬🇧 Intrusive advertising and spamming are not allowed on the instance.
10. 🇷🇺 На инстансе запрещена публикация чьих-либо личных данных без прямого и явного согласия владельца этих данных. 🇬🇧 It is forbidden to publish anyone's personal data on the Instance without the express and explicit consent of the owner of that data.
11. 🇷🇺 На инстансе запрещена пропаганда (идеологическая и религиозная). 🇬🇧 Propaganda (ideological and religious) is forbidden on the instance
12. 🇷🇺 На инстансе запрещена публикация изображений и текстов, содержащих обнаженную натуру и сцены насилия, без скрытия из под тэгом NSFW. 🇬🇧 It is forbidden to publish images and texts containing nudity and violent scenes on the instance without hiding them under the NSFW tag.

Privacy Statement

At the time of registration, and for providing communications between the user account and their contacts, the user has to provide a display name (pen name), a username (nickname) and a working email address. The names will be accessible on the profile page of the account by any visitor of the page, even if other profile details are not displayed. The email address will only be used to send the user notifications about interactions, but won’t be visibly displayed. The listing of an account in the node's user directory or the global user directory is optional and can be controlled in the user settings, it is not necessary for communication.

This information is required for communication and is passed on to the nodes of the communication partners and is stored there. Users can enter additional personal information that may be transmitted to the communication partner's accounts.

At any point in time a logged in user can export their account data from the account settings. If the user wants to delete their account they can do so at https://lastfree.space/settings/removeme. The deletion of the account will be permanent. Deletion of the data will also be requested from the nodes of the communication partners.
